Salt Lake City, Utah November, 2001 - A policy limits settlement of $330,000 was reached on behalf of a 16-year-old boy, whose name is kept confidential for settlement reasons, who suffered an injury when he fell from a bicycle. The fall was caused when the front tire fell off of the bicycle while he was riding. The defendants were the owner of the bicycle and the bicycle shop that had sold it.

Discovery in the case showed that the family who owned the bicycle had moved prior to the accident and it was unclear whether they had detached the front wheel from the bike. The bike owner claimed he had not done so, yet the bicycle shop claimed their records proved that there was no way the tire could have fallen off without the interference of some third party. The defendants also claimed that the boy had some involvement in loosening the tire. The boy still suffers from short-term memory and judgment problems. The defendants in the case claimed that his problems were caused by an attention deficit disorder. The attorneys at Eisenberg Gilchrist & Morton were able to convince the homeowner's insurance carrier to pay policy limits of $300,000 and obtained an additional $30,000 from the bicycle shop.
